ARTICLE 4 - TERMS RELATED TO MEMBERSHIP:

4.1 Membership Application

4.1.1 Membership to bisaatal.com can be initiated by filling out the membership form appropriately. Everyone who applies for membership by clicking on the relevant acceptance notification to bisaatal.com declares, accepts, and undertakes that they have read and accepted all the provisions of this agreement, have the necessary conditions for membership, and this agreement will become binding on them in accordance with their will and law. bisaatal.com reserves the right not to accept the membership application of anyone who wishes to benefit from the services subject to this agreement.

4.1.2 The accuracy and legality of the information provided during the membership application are declared, accepted, and undertaken by the applicant. In case it is determined that the information provided is illegal or contrary to law, the membership may be canceled. In this case, the member declares, accepts, and undertakes that they will not claim any product, service, expense, compensation, etc., for any transaction they have made through bisaatal.com, and therefore, bisaatal.com cannot be held responsible. bisaatal.com reserves the right to claim the paid amounts, if any, and to take back the delivered product.

4.1.3 Membership, at the discretion of bisaatal.com, can be initiated from any of the service channels. The member who wishes to enter into the contract relationship by applying for membership through electronic communication tools acknowledges and undertakes that manual signature will be required for the establishment of the legal relationship, and no separate confirmation with a wet signature will be required for this legal relationship.

4.1.4 The member is obliged to enter the mandatory information for membership correctly and completely during the membership application. Persons who meet the membership conditions are obliged to complete their other information that may be requested by bisaatal.com from bisaatal.com or customer services after the application has been completed.

4.1.5 The member declares, accepts, and undertakes that they carefully read and accept the terms of the contract, have the ability to keep a copy of the membership agreement if desired, and can easily access any changes or additions, data transfers, and service usage conditions that may occur from time to time. Changes or additions to the contract terms are presented to the member upon their first entry to bisaatal.com. The membership of the member who does not click the "accept" option presented to them is terminated without any obligation of compensation or similar. The member agrees and undertakes to fulfill the membership conditions throughout the term of the contract.

4.2 Start of Membership

Upon initiation of membership by bisaatal.com, a confirmation notification regarding the initiation of membership is sent to the email address provided by the member via email. With the acceptance and initiation of membership, the member can start benefiting from the services of bisaatal.com.

4.3 Use of Member Account

4.3.1 Each member can only have one member account. The member account can only be used for the purpose of benefiting from the services defined in this agreement. The member cannot use the services offered by bisaatal.com in any way contrary to law and public morality, disturbing to others, for the purpose of selling the service or product, and cannot allow others to use it.

4.3.2 The member is responsible for maintaining the confidentiality of the password, and the use of the member account with the password is deemed to have been made by the member. For this reason, the member is responsible for all transactions made through their account. Bisaatal.com cannot be held responsible for any direct or indirect damages that may arise due to the use of the member account by unauthorized persons. In case of unauthorized use of the member account or suspicion of unauthorized use, the member must immediately notify bisaatal.com. Bisaatal.com reserves the right to take all necessary precautions to ensure the security of the member account in such cases.

4.3.3 Members cannot request the cancellation of membership by sending an e-mail or SMS to bisaatal.com without any notice or explanation. It can only be canceled by the written request of the member sent to the customer services by fax or post. If the member cannot be reached by phone, the process must be completed in person.

4.4 Rights and Obligations of the Member

4.4.1 The member declares, accepts, and undertakes that they are authorized to perform all transactions and legal actions within the scope of the products and services subject to this agreement.

4.4.2 The member accepts and undertakes not to access or use the services provided by bisaatal.com by using any method other than the interface and instructions provided by bisaatal.com. Members cannot access the services of bisaatal.com by automated means, such as robots, spiders, scrapers, etc., or use other manual or automated methods that may prevent or disrupt the use of the services by others.

4.4.3 The member declares, accepts, and undertakes that they will comply with all provisions of this agreement and all legal regulations and will not violate the rights of third parties within the scope of the transactions they perform on bisaatal.com.

4.4.4 The member agrees and undertakes that they will not use any software, application, code, and hardware, including but not limited to viruses, Trojans, and malicious software, that may cause harm to the services of bisaatal.com or the systems of users, members, or third parties, and will not engage in any activity that may disrupt the services of bisaatal.com, or use or sell the services, data, or software of bisaatal.com. The member acknowledges and undertakes that any violation of this provision will result in the termination of the contract, cancellation of membership, and other legal remedies.

4.4.5 Members are responsible for the protection, backup, and maintenance of the information and data they provide, and bisaatal.com cannot be held responsible for the deletion, loss, or corruption of any data or information provided by the member. Members cannot claim any rights, including but not limited to compensation, against bisaatal.com.

4.4.6 The member agrees and undertakes that they will not use the services of bisaatal.com to carry out activities such as spamming, commercial electronic messages, etc. If such activities are detected, the member's membership may be suspended or terminated, and necessary legal actions may be taken.

4.4.7 The member agrees and undertakes that they will not provide access to their account to others or transfer their rights and obligations under this agreement to others without the written consent of bisaatal.com.

4.4.8 The member agrees, declares, and undertakes that they will act in accordance with all procedures and principles specified by bisaatal.com in order to benefit from the services provided by bisaatal.com.

4.4.9 The member agrees, declares, and undertakes that they will not use the services provided by bisaatal.com for commercial purposes, directly or indirectly, without the written permission of bisaatal.com.

4.4.10 The member cannot provide access to the services of bisaatal.com or to any information, document, image, video, software, code, program, algorithm, or similar work included in these services to third parties or entities in any way without the written permission of bisaatal.com.

4.4.11 Members agree, declare, and undertake to comply with all kinds of warnings and announcements made by bisaatal.com regarding the services provided.

4.4.12 The member agrees and undertakes to comply with all kinds of intellectual and industrial property rights of bisaatal.com within the scope of the services provided by bisaatal.com and not to violate them in any way. In the event of any violation, the member acknowledges and undertakes that all legal and penal liability will belong to them.

4.4.13 Members cannot claim any compensation or similar rights for any transaction they perform through bisaatal.com, regardless of whether they have become members or not, and acknowledge and undertake that they will not file any lawsuit or similar procedure against bisaatal.com.

4.5 Rights and Obligations of Bisaatal.com

4.5.1 Bisaatal.com reserves the right to verify the information provided by the member during the membership application and to request additional information and documents from the member if necessary. bisaatal.com reserves the right to request the presentation of the original or certified copies of the documents provided by the member when deemed necessary.

4.5.2 Bisaatal.com reserves the right to change or cancel the membership of any member who violates the provisions of this agreement or uses the services in a manner that disrupts the operation of bisaatal.com, without any notice, warning, or justification, and to initiate legal and criminal proceedings against them. In such cases, the member cannot claim any rights, including compensation, against bisaatal.com.

4.5.3 Bisaatal.com reserves the right to change or update the terms and conditions of this agreement and the services provided through bisaatal.com at any time. The member is deemed to have accepted these changes or updates by continuing to use the services provided by bisaatal.com after the changes or updates have been made.

4.5.4 Bisaatal.com reserves the right to change, update, or discontinue the services provided through bisaatal.com at any time. In such cases, the member cannot claim any rights, including compensation, against bisaatal.com.

4.5.5 Bisaatal.com may use third-party providers to provide services. However, this does not mean that Bisaatal.com has any responsibility or commitment to the members regarding these services.

4.5.6 Bisaatal.com may provide links to other websites or resources on the internet. However, this does not mean that Bisaatal.com has any responsibility or commitment to the members regarding these websites or resources.

4.5.7 Bisaatal.com is not responsible for any direct or indirect damages that may arise from the use of the services provided through bisaatal.com or the use of the products purchased through bisaatal.com.

4.5.8 Bisaatal.com cannot be held responsible for any interruptions, delays, errors, omissions, or losses that may occur during the provision of services or the operation of the website due to technical problems, server failures, or other reasons beyond its control.

4.5.9 Bisaatal.com may suspend or terminate the provision of services at any time for technical, maintenance, or other reasons without prior notice.

4.5.10 Bisaatal.com may terminate the membership of members who do not log in to the website or use the services provided for a certain period determined by bisaatal.com without prior notice.

4.5.11 Bisaatal.com cannot be held responsible for any damages that may occur due to the deletion, loss, or corruption of any data or information provided by the member or any other person.

4.5.12 Bisaatal.com cannot be held responsible for any damages that may arise due to the unauthorized access of third parties to the member accounts.

4.5.13 Bisaatal.com may use the information and data provided by the members within the framework of the personal data protection legislation and the privacy policy.

4.5.14 Bisaatal.com may use cookies to improve the services provided and to offer a better user experience. Members can change their cookie settings at any time.

4.5.15 Bisaatal.com may use the contact information provided by the members to send commercial electronic messages. Members can choose not to receive commercial electronic messages by changing their communication preferences.

4.5.16 Bisaatal.com cannot be held responsible for any damages that may arise due to force majeure events.

4.6 Termination of the Agreement

4.6.1 This agreement shall remain in force until terminated by the member or bisaatal.com.

4.6.2 The member may terminate this agreement at any time by closing their account and discontinuing the use of the services provided by bisaatal.com.

4.6.3 Bisaatal.com may terminate this agreement at any time without prior notice or justification if the member violates any provision of this agreement or uses the services provided by bisaatal.com in a manner that disrupts the operation of bisaatal.com. In such cases, the membership of the member will be terminated, and the member cannot claim any rights, including compensation, against bisaatal.com.

4.6.4 In the event of termination of this agreement, the rights and obligations of the parties arising from this agreement shall continue to be valid until all legal and financial obligations are fulfilled.

4.7 Applicable Law and Jurisdiction

4.7.1 This agreement shall be governed by Turkish law.

4.7.2 Istanbul Anatolian Courts and Enforcement Offices are authorized to resolve any disputes arising from this agreement.

4.8 Enforcement

4.8.1 If any provision of this agreement is held to be invalid, illegal, or unenforceable, this shall not affect the validity, legality, or enforceability of the remaining provisions.

4.8.2 The titles and headings used in this agreement are for convenience only and do not define, limit, or describe the scope or intent of this agreement.

4.8.3 This agreement, consisting of 20 articles, has been read and understood by the parties and entered into force by mutual consent.
